Conditions of participation for the
“Zermatt Unplugged festival package” THE GREEN MOUNTAIN competition.

By taking part in the caompetition, participants agree to the following conditions of participation:

1. Organiser

The organiser of the “Zermatt Unplugged festival package” THE GREEN MOUNTAIN competition (hereinafter referred to as the “competition”) is Hilcona AG, Bendererstrasse 21, 9494 Schaan, Principality of Liechtenstein (hereinafter referred to as “Hilcona”).

2. Eligibility to participate

2.1. Natural persons who (a) are at least 18 years old and (b) have a residence and address in Switzerland or the Principality of Liechtenstein, as well as a valid e-mail address, are eligible to participate.

Employees of Hilcona, the Bell Food Group and their relatives, as well as employees and relatives of affiliated companies, are not eligible to participate.

2.2. To enter the competition, participants must enter an individual promotional code,
which they can find on one of the promotional products listed under point 4 bearing a promotional sticker, on the competition landing page at www.thegreenmountain.ch/zermatt during the promotional period from 29 January 2024 to 31 March 2024 at 23:59:59 (end of the redemption period), together with a valid e-mail address. Products can be purchased from participating food retailers.

Participants must agree to the conditions of participation and the privacy policy. Participants confirm that they have read and understood these participation requirements, and that they have effectively approved and meet all applicable conditions.

3. Participation and redemption period

The competition will take place at participating food retailers during the promotional period from 29 January 2024 to 31 March 2024.

The redemption period on the competition website www.thegreenmountain.ch/zermatt ends at 23:59:59 on 31 March 2024.

4. Promotional code

Promotional products with a promotional sticker featuring a promotional code for the Hilcona competition available from participating food retailers can be (non-exhaustive, non-binding list):

Not all promotional products listed are always available on the day of purchase and from all food retailers. To be eligible, it is essential for a product to have a promotional sticker.

5. Competition procedure

Participants must enter their individual promotional code and a valid e-mail address on the website www.thegreenmountain.ch/zermatt to take part in the competition.

The procedure on the competition landing page is as follows for participants:
1. Go to the page thegreenmountain.ch/zermatt
2. Enter the promotional code
3. Enter a valid e-mail address
4. Select the date for winning tickets, either 9 or 10 April
5. Agree to the conditions of participation and the privacy policy
6. Submit this data

Winners are chosen at random. Participants will be informed immediately after submitting their data whether they have won one of the prizes listed under point 7.1 and telephone number. Winners will receive further information by e-mail after checks have been made to ensure that the conditions of participation have been met.

Once the promotional code has been entered, it loses its validity and cannot be used again.

It is the participant’s responsibility to ensure that the required information is submitted completely and correctly. If the information provided is incorrect or incomplete and/or the winner cannot be contacted for reasons attributable to themselves, their claim to the prize will lapse at the end of the day on 5 April 2024.

6. Claim to prizes

6.1. The number of times a person may participate in the promotion is not limited. One person or household may take part in the promotion multiple times if they have several purchase receipts and different promotional codes.

6.2. Participants must use their own name when participating.

6.3. Entitlement to the prize will also be forfeited if the participant provides false, incomplete or misleading information (date of birth, name, postal address).

6.4. Participants who use unauthorised aids or otherwise gain advantages by means of manipulation will be excluded. In such cases, Hilcona may refuse to accept their participation, decide not to pay out the prize, or subsequently reclaim the prize or non-cash benefit.

6.5. The prize will be forfeited if the winner cannot be contacted via the e-mail address they have provided or if, after receiving the e-mail, they do not contact the organiser or the partner commissioned to run the prize draw by 5 April 2024 in order to supply the necessary information (see point 5).

Winnings cannot be paid out in cash. Prizes are not transferable to third parties. In individual cases, there may be delays in the provision of prizes.

The prizes will be sent either DIGITALLY by e-mail, by post or will be handed over in person in Zermatt. After each winner has been drawn, they will receive detailed information about the prize and its receipt, provided that the winner’s data required for processing the competition, as listed in the conditions of participation, is available.

If prizes are sent by post, subsequent changes to a participant’s postal address cannot be taken into account. Postage costs within Switzerland or the Principality of Liechtenstein are included in the prize. The winner must ensure that they are able to take receipt of the prize. If delivery is not possible, the winner will bear all subsequent postage costs. Please note that we cannot accept any responsibility if letters (consignments) are lost in the post.

7. Prizes

7.1. 20 Zermatt Unplugged packages

The package contents are listed below. The additional terms and conditions of the organiser visible at https://zermatt-unplugged.ch/en/gtc/ apply to the trip or event.

A. 2 Zermatt Unplugged passes per package
– Zermatt Unplugged passes for 2 people (the winner and one companion),
valid from 9 April to 13 April 2024
– Each Zermatt Unplugged pass includes access to the Taste Village, all Unplugged Pass stages and the After Parties

B. 2 tickets each for a concert on the Marquee Stage on 9 or 10 April 2024
– When taking part in the competition, participants can choose whether they would like to win tickets for 9 April or 10 April 2024. The date can no longer be changed if they win. The tickets will be handed over at the exclusive Tavolata in the Cervo Mountain Resort
– Please check the programme to see which artists will be performing each day. We have no control over the artists who will perform. The organiser reserves the right to make changes. You can find the Zermatt Unplugged programme here.

C. Tavolata at the Cervo
– Two exclusive The Green Mountain Tavolata events will take place at the Cervo Mountain Resort. For winners of tickets for the concert on the Marquee Stage from 13:00 to 14:00 on 9 April 2024 and for winners of tickets for the concert on the Marquee Stage from 13:00 to 14:00 on 10 April 2024 on the day of the relevant concert. Indoors or outdoors, depending on the weather.
– The tickets for the Marquee Stage will be handed over there.

D. Travel allowance and overnight stay
– Travel allowance: CHF 200.00 per winner
– Overnight stay in a double room in a 4-star Zermatt Unplugged partner hotel, including breakfast. For winners of tickets for the concert on 9 April 2024 for the night of 9 to 10 April 2024, and for winners of tickets for the concert on 10 April 2024 for the night of 10 to 11 April 2024
– Important: Zermatt is a car-free zone. Access for private transport is only permitted as far as Täsch (5 km before Zermatt)

7.2. Further provisions regarding prizes

The event is scheduled for a fixed date, and the prize can only be redeemed on this date. There is no alternative date. If the date is not adhered to, the prize will be forfeited without substitution. Likewise, if the trip/event does not take place or takes place on a different date due to force majeure and/or a decision by the organiser, the prize will be forfeited without compensation. Winnings may not be paid out in cash, in kind, exchanged or transferred to other persons. Winners may choose to forfeit their prizes.

If the contact details provided are incorrect (e-mail address or postal address etc.), the entitlement to the prize will lapse. Hilcona is not obliged to research the correct data. Any disadvantages resulting from the provision of incorrect data shall be borne by the participant concerned.

We also kindly ask participants to check whether the prize notification has been sent to their SPAM or junk mail folders.

If, contrary to expectations, prizes are not available or not available in sufficient numbers, Hilcona is entitled to provide an appropriate equivalent.

8. Data protection

Personal data about the participants, such as the name and the (e-mail) address provided, will be processed by Hilcona in compliance with the provisions of the Federal Act on Data Protection (FADP) for the purpose of organising and running the competition. By participating in the competition, the participant agrees to the processing of their data by the organiser.

The participant acknowledges that their personal data will be transmitted to CMF Advertising GmbH exclusively for the purpose of carrying out and processing the promotion.

Participants agree that photo and video material (visual personal data) may be taken at the Tavolata, when tickets are handed over and/or at Zermatt Unplugged, and published on the social media channels of THE GREEN MOUNTAIN and Hilcona. By accepting the prize, the winner declares their consent to the production of photo and video material. In addition to consent, this processing is also based on Hilcona’s overriding interest within the meaning of Art. 31 para. 1 FADP; by organising the competition and making the prize attractive, Hilcona has a strong interest in transparently demonstrating that the prizes offered were authentic, and the competition and the claiming of the prize should also have a positive effect on the company and THE GREEN MOUNTAIN brand. This overrides the right of the winner to apply for the free use of the prizes awarded by participating in the competition. There is nothing preventing the winner from not accepting the prize. The use of images and videos is not limited in terms of time, location or space. Hilcona does not owe any compensation for the use of images and videos.

Any other personal data required for the organisation and processing of the promotion will subsequently be deleted. In addition, the general data protection provisions apply.

9. Updates to the conditions of participation and data protection provisions

Technical modifications or legal changes may cause Hilcona to update, delete or change parts of the conditions of participation and data protection provisions. Participants are therefore asked to visit the promotion page from time to time on their own responsibility to remain up to date. The current status of the conditions of participation and data protection provisions can be found on this page. The original terms and conditions shall continue to apply to legal acts performed prior to the amendment.

10. Applicable law, exclusion of legal recourse

Legal recourse is excluded in connection with this competition and the distribution of prizes.

11. Other rules

Should individual clauses be or become invalid or unenforceable in whole or in part, this shall not affect the validity or enforceability of the remaining clauses. An invalid/unenforceable clause shall be replaced by a new provision that comes as close as possible to the meaning and economic purpose of the invalid/unenforceable clauses. The same applies to the filling of any loopholes.

12. Liability

Hilcona shall only be liable in accordance with the following provisions:

Liability is unlimited in the case of intent or gross negligence and in the case of a guarantee. Liability is also unlimited in the event of injury to life, limb or health, and in cases of product liability. Any further liability is excluded to the extent permitted by law.

No claims may be made against Hilcona, the participating agency or partners if the website is temporarily unavailable. Hilcona is not liable for any loss of data and any resulting damage.
